Abstract

This study analyzes the protection of cultural rights as a fundamental element for the consolidation of the Democratic Rule of Law, highlighting its intersection with human rights and access to justice. It addresses the historical evolution of cultural rights in constitutional theory, emphasizing their transition from a notion of legal interest to their consecration as collective fundamental rights. The article argues that the implementation of these rights is crucial for the promotion of human dignity and the appreciation of cultural diversity, proposing that access to justice is a vital mechanism for ensuring the effective protection of these rights in a society marked by inequalities. It is concluded that overcoming the challenges in guaranteeing cultural rights requires an interdisciplinary approach, with specific public policies and the active participation of civil society, aiming at the democratization of culture and social justice.
