Abstract

The purpose of this paper is to characterize and discuss the importance of personal data protection in the information society, as well as whether personal data should be protected by criminal law. The study also takes into account the origin and characteristics of the information society and how criminal law is situated with new technologies and computer crime. Yet the analysis takes into account the value and importance that personal data has in the information society and how its protection tends to be applied in the legal world as a whole and after dealing with how. The work uses the deductive method for its descriptive analytical approach, through literature review. In this way, a doctrinal and normative research was done on the subject, seeking a greater perception of the protection of personal data in the criminal sphere. As a result, the work shows that in the criminal sphere personal data around the world has not been targeted in the criminal sphere but in other spheres of law.
