Abstract

CONVERSÃO DO DIREITO POSITIVO AO DIREITO SUBJETIVO MODERNO

THE CONVERTING OF POSITIVE RIGHT INTO THE MODERN SUBJECTIVE RIGHT

Direito subjetivo. Hermenêutica. Sujeito.

ABSTRACT

This text is intended to explain the passage from positive Law to subjective Law. To do so we will follow the historical description of the classic book by Michel Villey. This discussion is important once it incorporates the centrality of man within the legal reflection. To put the subject as the center of legal debate, as we know, was only possible with the entry of subjectivity in philosophical discourse.

KEYWORDS: Positive law. Subjective Law. Hermeneutics. Subject.
