Abstract

The election of certain governing politicians, such as Donald Trump in the United States or Viktor Orbán in Hungary, appears today as a culminating point of a phenomenom that interprets democracy in a depreciative way and infringes human rights of refugees. Given this situation, one wonders how the relationship between contemporary populism and the current refugee crisis is developping. In regards to this, it is understood that the relationship is conflicting in this sense that certain populist governments usually use legal and political measures to prevent the entry or resettlement of refugees in their territory. For this reason, it is recomended that the principle of non-refoulement as a norm of jus cogens be respect, since if they are disregarded by certain measures or behaviour of these governments, they may give rise to a possible international responsability of State involved. Therefore, it is necessary to explain what contemporary populism means as a threat, to analyse the mechanisms used by populist government to prevent the entry of refugees and finally, to raise solutions under international Law based on the principle of non-refoulement and international responsability of the State.
