Abstract

The article analyzes the counterpoint between the Brazilian legal culture of administration of criminal conflicts, marked essentially by the sentence and its punitive concept, and the restorative justice, which emerges as a dialogued and consensual alternative to the retributive model. It analyzes the main characteristics of restorative practices in Brazil, discussing especially about criminal mediation. Finally, it deals with the obstacles and challenges for the implantation and expansion of restorative practices in Brazil, with the scope of modifying the culture of treatment of criminal conflicts, recognizing that the Law Courses in Brazil still maintains the retributive and punitive models in its educational structure.
