Abstract

The purpose of this article is to verify whether technology and its innovations have contributed to guarantee equal access to justice, from the perspective that the right to justice is the most basic right of human rights. Initially, the theoretical and factual vulnerability scenarios and the legal instruments present in the digital environment will be analyzed. The consequences of its use will also be identified. In the end, we ponder the need for digital inclusion to democratize access to justice. The hypothesis was verified that the social isolation imposed by COVID-19 increased the high levels of inequality through digital apartheid and that there is no way to conceive access to justice without democracy. The hypothetical-deductive method will be used and bibliographic and documentary research will be carried out, with a study of the literature and legislation applied to the theme.
