Posse. Ação Publiciana. Direito Real.

It is based on the domain model in Oliver Lepsius in which the constitutional road to property is guaranteed by null standards, the relationship is objective, ie, between person and well, and is called Domain factual. This branches into two subspecies: Domain Legal, which comprises the Real Rights, protected by action of petition, and Domain of Fact, which covers the tenure extended in time, covered up requirements, finding their protection in Action Publiciana.

Keywords: Property. Domain. Possession. Action Publiciana. Real Right.
